These Terms & Conditions (“Terms”) govern your use of bwdmedia.co.nz and related services. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

1. Definitions

“Site” means bwdmedia.co.nz and all related subdomains.

“User” means any visitor to or user of the Site.

“Bwd Media” means Bwd Media Limited, NZ Company No 9429041450918.

2. Eligibility & Acceptance

You represent that you are at least 16 years old and have capacity to enter into these Terms. Use for any unlawful or unauthorised purpose is prohibited.

3. Licence to Use Site Content

We grant you a limited, revocable, non‑exclusive licence to view and download Materials (text, images, code) for your personal or internal business use only. Any other copying, distribution, modification or commercial use is strictly prohibited without our prior written consent.

4. User‑Submitted Content

Any content you submit (e.g., enquiries, comments, files) remains your property, but you grant us a perpetual, royalty‑free, worldwide licence to use, reproduce, adapt, publish and distribute it for any purpose. You may request removal of your content by emailing info@bwdmedia.co.nz; we will remove it within 30 days, except where required by law or project obligations.

5. Intellectual Property

All trademarks, service marks, logos and trade dress are our property or used under licence. Nothing on the Site grants any rights in or to any branding except as expressly provided.

6. Cookies & Tracking

Your use of the Site constitutes informed consent to our use of cookies as set out in our Privacy Policy, including for analytics and advertising. You may withdraw consent at any time via the cookie banner or your browser settings.

7. Disclaimers & Limitation of Liability

Consumer Guarantees Act: Nothing here limits your rights as a consumer under the Consumer Guarantees Act 1993.

No Warranty: The Site and Materials are provided “as is” without any warranty of accuracy, fitness for purpose or non‑infringement.

Liability Cap: To the maximum extent permitted by law, our total liability for any claim arising from the Site or these Terms is capped at NZD 500. We are not liable for indirect, special or consequential losses (except as required by law).

8. Indemnity

You agree to indemnify and hold Bwd Media harmless from any losses, liabilities, claims or expenses arising from your breach of these Terms or misuse of the Site.

9. Dispute Resolution

If a dispute arises, we ask you to first contact us at info@bwdmedia.co.nz to seek a resolution. If unresolved within 30 days, either party may refer the matter to mediation under the Dispute Resolution Services of New Zealand Rules. Failing settlement, disputes will be heard exclusively in the New Zealand courts.

10. Changes to Terms

We may amend these Terms at any time by posting a revised version on the Site. Continued use after changes indicates acceptance.

11. Governing Law

These Terms are governed by the laws of New Zealand. Exclusive jurisdiction rests with the New Zealand courts.

13. Support & Service Level Agreement (SLA)

For critical issues (e.g. site outages or security incidents), please email support@bwdmedia.co.nz with URGENT in the subject line. Our SLA guarantees a response within 24 hours. We also prefer you send us a text message; if you don’t hear back, please call 027 626 7971 or email info@bwdmedia.co.nz.
